DMCA Policy
Carbonara Recipe respects the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged infringement that comply with the DMCA and other applicable laws. This policy outlines the information required to submit a notification of alleged infringement to Carbonara Recipe, as well as information regarding submitting a counter-notification if your content has been removed.
Filing a DMCA Notice of Infringement
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via Carbonara Recipe, please provide our Copyright Agent with the following information in writing (see 17 U.S.C. ยง 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest;
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
- Identification of the material that you claim is infringing and where it is located on Carbonara Recipe (e.g., the URL of the specific page or post);
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
DMCA Counter-Notification
If you believe that your content was removed by mistake or misidentification, you may send a counter-notification to our Copyright Agent. Pursuant to Sections 512(g)(2) and (3) of the DMCA, your counter-notification must include substantially the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
- Your name, address, and telephone number;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled;
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Carbonara Recipe may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
